TRAINING AND ASSISTANCE:
Training will be conducted for up to two persons, one of whom must be the franchise owner. The training program will be conducted over an eight week period in the Brantford location. An additional four weeks of training will take place at the franchisee's restaurant at the time of opening. The franchisee and management employees may be required to attend additional training and meetings. The franchisor will provide a representative for up to fourteen days following the first week of opening a restaurant to assist in the setup and initial operation.
The franchisee will receive a protected area around the franchise location. The protected area will be the area within a 20 kilometre radius of the franchise location, except in densely populated areas where the protected area may be smaller. In those cases the territory will be agreed to by the parties. During the term of the franchise agreement, the franchisor will not operate or authorize others to operate a retail restaurant business using the Gus & Guido’s trademarks or system at a location within the protected area.
TERM OF AGREEMENT AND RENEWAL
The term of the franchise agreement is 10 years and can be renewed for two 5-year periods thereafter.
OBLIGATIONS AND RESTRICTIONS
The franchisee must, among other things defined more specifically in the franchise agreement:
1) Devote their full time and attention to the active management and operation of the franchise business.
2) Preserve and exercise ultimate authority and responsibility with respect to the management and operation of the franchise business.
3) Represent and act on behalf of franchisee in all dealings with the franchisor.
4) The franchisee must sell all products and services specified by the franchisor. The franchisee may not offer any products or services that have not been authorized.
5) The franchisee may deliver immediately consumable products consistent with the catering format (G&G Corp.) but any other provision or delivery of products is prohibited without prior written consent from the franchisor.
